It has taken 3 years but today the judge announced that

Amie van Dyk is Ayn van Dyk's legal guardian and she is going home!

TODAY IS JUNE 3, 2014 ~ DAY 1083 and AYN IS COMING HOME!

STILL WAITING

It is April 2, 2014 and everyone is still waiting to hear some good news that Ayn is coming home. Most importantly Ayn has been waiting for now 1021 days to see her daddy and her brothers who love and miss her very much. The ache in their hearts must be unbearable. Still there appears to be no reasonable explanation for why so many suffer the pain of loss this great................

It is Nov 30, 2013 and everyone is still waiting ~ AYN IS STILL WAITING after missing her family for 897 days. Her family is still working tirelessly to get her home again. To that effort they will be returning to court on Dec 19th. Let us all keep positive thoughts and pray for the best possible outcome in 19 days. This little girl enjoys frequent visits with her mom but she needs to be home with her family permanently.

Yesterday, Dec 7, 2012 after Ayn had been waiting for 539 days her Daddy, Derek Hoare was finally able to make this announcement

"I have some big news, which will be difficult to explain in a single post, I will get online this weekend to elaborate. Ready... Ayn is coming home! an agreement was signed on tuesday for her return. it is a sect 60 agreement with no finding of a need for protection. I cannot explain the flood of emotions we are experiencing. I am ofcourse elated and will come online in a day or two, I'm tediously typing this on my phone but will spend much more time when I come on. Thank you so very much everyone."

This is a story about a tragic event that should never have happened at all!

I began this blog on September 1, 2011 and would not have believed I would be here writing this today, August 28, 2012 ~ 12 months later. This family who love each other so much have now been separated for 438 days. There are many blog postings here for you to read but I would direct you first to http://www.freedomforayn.blogspot.ca/2012/04/from-beginning-of-story.html You will wonder why the last date of reporting was in Jan 2012 and the only reason is that there has been nothing else to report. That's right, there has been no positive movement on the part of MCFD, Derek has had no reports about his daughter. This is totally unacceptable!


Hope is that thing with feathers that perches in the soul and sings the tune without the words and never stops... at all.

Today, this beautiful young girl celebrates her 12th birthday. 

This is the third birthday since she was taken from her family.

A SCARY STORY

The story began on June 16, 2011 when Ayn van Dyk was 11 years old. Since then thousands around the world have waited with hope and prayers that we would hear the happy ending we long for her family to enjoy!

We have heard little from Derek since then as he struggles to deal with grief of this great loss for his family while caring for his two sons.

Twelve months later on Dec 4, 2012 just prior to long awaited court dates the Ministry of Child and Family Development, British Columbia, Canada along with Ayn's parents Amie van Dyk and Derek Hoare announced that Ayn would be going home to be with her family after she had been held unjustly in captivity for 536 days. There had never been any grounds to question their parenting skills, Ayn never needed their protection.

On Dec 7, 2012 Derek announced that an agreement was signed with MCFD on Dec 4 - Ayn would be coming home! 

We rejoiced and we waited.............................

On July 5, 2013 Amie van Dyk told us, "Today the Ministry presented another gradual return plan. This one is 13 weeks in length."  So by the end of September, 2013 this family would finally be reunited. Since the waiting had already been 107 weeks, 13 more could be tolerated, knowing Ayn would be spending time with both her parents to prepare for her move home. Strange that she needed no preparation when she was taken on June 16, 2011 but now there would be a 13 week transition. BUT she was coming home.......................

As I write today, Oct 31, 2013, Halloween ~ a day for all things scary, I pondered the thought that this story is the scariest! We have now been watching this family live the terror for 867 days worried about the safety and well being of their daughter. We are now 5 weeks beyond the 13 week plan for transition.

This morning Amie, Ayn's mom, tells us she continues to see Ayn and that they will be in court on Nov 5, 2013. I so admire her strength and her willingness through such difficulty to keep the world informed as we continue to wait with hope, praying for that happy ending.

IT IS CANADA DAY, JULY 1, 2013

Today is the third Canada that Ayn van Dyk has not be able to celebrate with her family.

I AM CANADIAN and should be celebrating our 146th birthday but not. Today I reflect on how our Governments across this great land (Federal, Provincial, Municipal) KNOWINGLY allow so many children's lives to be destroyed by the criminal actions of those they pay and empower to protect our children. 

When we seek to find justice we find another corrupt system that condones the actions of these criminals. Are there no Canadians with conscience within government who want to make this right? We are a country rich in resources and we should be caring for our greatest resource - our children!

A little girl with autism was unjustly stolen from her family by Child Protective Services 745 days ago. Within days a hospital report stated no signs of abuse or neglect. After holding her in captivity for 536 days the court date was canceled as they announced on Dec 4, 2012 that she would be going home to her family who had been good, loving parents. Now 209 days later, when they have still not taken her home, we learn there is a plan to move her to another foster house. The cruelty and crime being perpetrated against this child and her family is __________! (I am a loss for words here ~ what words would you put in the blank)

Since the very early days in this story back in the summer of 2011 all levels of Government have been kept very aware of this crime that has yet to be dealt with justly in our courts. 

HOW CAN I CELEBRATE the greatness of this country? Ayn van Dyk, who should be living with her family in Abbotsford, BC is just one child of thousands in this country being treated unjustly.

Please help me to help Ayn. Share a link to this story wherever you can, perhaps a viral message will shame our governments today and bring them to do whatever they can to right this wrong!

WHEN WILL SHE BE HOME?

On Dec 4, 2012 The Ministry of Child and Family Development, British Columbia, Canada along with Ayn's parents Amie van Dyk and Derek Hoare announced that Ayn would be going home to be with her family after she had been held unjustly in captivity for 536 days. There had never been any grounds to question their parenting skills, Ayn never needed their protection.

It is now June 28, 2013 and 206 days later. We wait with Ayn and her family for this reunion to take place. How do we begin to understand how and why this can happen in the great country of Canada?

AYN STILL WAITS TO GO HOME

Two years ago, this beautiful 9 year old child with autism was stolen from her family by Child Protective Services in Abbottsford, BC, Canada. In Dec 2012, after 536 days of Ayn being held in captivity, the BC Ministry of Child and Family Development stated that Ayn was never in need of their protection, dad's parenting skills were never in question and she would be soon going home to her family.

This was a picture taken of Ayn not long after she was abducted.

It has now been 731 days since Ayn was abducted from school. She has missed many happy days where she thrived with her family including 2 birthdays, 2 Christmas celebrations, 8 birthday celebrations for her parents and 2 brothers at home while she was living alone in a basement suite of a foster house with paid staff to watch her while the foster parents (very well compensated financially) worked and went about their daily lives.

With constant crying for Daddy, Ayn was given a picture of Daddy, Derek Hoare.

The BC Government is ultimately responsible for this travesty (and many others like it) ~ they are all very aware of and ignoring Ayn's story while collecting thousands of dollars of federal funds monthly to pay for depriving her of the happy family life she has a right to enjoy. Oh, and our Federal Government, including Mr. Harper the Prime Minister of Canada, are very aware of the many children in similar situations being denied their basic human rights with no consideration of justice.

It has now been 195 days since thousands of supporters celebrated the announcement that Ayn was coming home................ she is still waiting for this joyous occasion!

A MESSAGE FROM MOM

It has been a very hectic month. I started a new job with irregular hours and moved to a new apartment. Moving was a process. Finding a place that was suitable for my children that was willing to accept dogs was a challenge. I find this new job leaves me physically exhausted with very little free time. 

Seeing Ayn has become much more difficult. Ayn is in school Monday-Friday and needs to get to bed at a reasonable time for school in the morning and the majority of my shifts are completed in the evening. The foster home also needs to be able to arrange transportation for Ayn to visit and that requires juggling. I've done my best to see Ayn as much as possible, though it has usually been limited to once or twice a week. I'm hoping when school is out for the summer this will pick up a bit. 

Ayn was over yesterday and we had a great time. I was wondering how she would react to her new surroundings here. Ayn had previously expressed that she did not want to go to the new house. I attribute that to her fear of the unknown. Ayn becomes very set in her ways and desires consistency in most aspects of her life.

As it turns out, once she was here, she thankfully was very accepting and happy to be here. Again I hear that she doesn't want to leave when the visit draws to a close. I have a hard time with that myself. I do my best to validate her feelings and let her know I miss her and she'll see me soon.

Derek has also moved. I am optimistic that things will be moving in the right direction for him and the boys. He has met with the new social worker. I have not yet had any contact with her but will try to reach her today to introduce myself and hopefully (somehow) arrange a time that we can meet.

As far as over nights go, the previous social worker left the decision in the hands of the new social worker. As far as Ayn being returned to her parents... Now that Derek has completed his move, he is in the process of setting up an intervention program for our son. He has hired a BI that seems to be an excellent fit for our family.

I'm still not sure what the Ministry believes I have done that indicates Ayn should not have been with myself or Derek all along. I have never been asked to do anything more than have social workers monitor my interactions with Ayn and investigate my home to ensure it is a safe environment for Ayn, provide criminal record checks, etc. I have also had contact a behavioral consultant because, guess what? Ayn has autism which isn't going away, and neither am I. If all else fails, we will have a second Case Conference on July 4th.

WE HAVE NOT FORGOTTEN YOU AYN!

STILL WAITING

It is May 2, 2013 and 685 days since Ayn was first taken from her family. In 2 days we will all have been waiting 5 months with hope and prayers to hear that Ayn is now home with her family. On Dec 7, 2012 Derek announced that an agreement was signed with MCFD on Dec 4 - Ayn would be coming home!

At that time Derek anticipated this would not be a speedy process and would perhaps take months. We have not heard from Derek since then. He has chosen to continue to plan for Ayn's return in private with his family. This writer has great respect for the decisions he has made. As Ayn's dad, he knows what is best for his family. When the time is right I hope we will hear that Ayn has been home for some time and all is well!

There has been some progress made with Amie, Ayn's mom who for most of the past 21 months had sporadic, supervised visits with Ayn, never in her home. The good news is that Ayn is now having unsupervised visits at mom's place twice a week and if not already, soon to have overnight stays! The visits are going well, Ayn and mom finally spending time doing things they enjoy doing together.

Ron Unruh also wrote this beautiful poem as he thinks about what Ayn is doing and feeling during this transition period to reunion with her family. His heartfelt words will not leave many dry eyes. Perhaps one day soon Ron will write another poem about Ayn's retrun to dad and her brothers.

Alas, although she will soon be home, she will not be home for this birthday and no one will know how she is celebrating. AYN IS COMING HOME!

Yesterday Derek joined the ever faithful facebook supporters to give them more information about Ayn’s return home. We now understand very well how busy he must have been the past months when there were no updates to give us. Besides homeschooling Ayn’s two brothers and preparing for the trial that was to have started this past week, Derek has been working with the best professionals, the experts of his choice, to plan for Ayn’s return. Until this week, actually only 3 days before the court trial date, it had been possible that the trial may have lasted for 2 months. At this time Derek and the team of professionals who will work with him now want time to make sure they are prepared to provide Ayn with the best transition possible. We hope then that he is able to arrange for her return when he and his sons are prepared for her return.

Derek begins: 

Thank you for all the warm thoughts everyone, it is definitely a relief to be drawing so close to an end of this entire ordeal. Upon hearing this news I too was overcome with emotion and cannot even begin to describe how it felt to hear those words. Elation to say the least. Let me address some of the individual comments so as to avoid any speculation.

Over a year ago in Sept 2011 I offered three possible ways to overcome the issue of visitation with the Ministry. One was to put someone in my home (they refused since this is not within their mandate), second was to consult an autism expert ( they refused to be bound by those recommendations), thirdly was to give me a fixed return date so I could explain to Ayn when she would be coming home (this was initially accepted with a return time of 4 months, 3 days later they changed their minds and the idea was rejected). The agreement we reached on the 30th and the 4th, does utilize one of these ideas, as we have agreed to enlist the help of an autism expert. As many of you may recall towards the end of 2011 the focus came to be a hunt for experts as Ayn had yet to see an autism specialist since taken into care and I was asked to produce a proposal for the services I would like to see for my kids. 

It was at this time which I began to seek the services of a prominent British Columbian doctor, whose experience with autistic kids and their philosophy surrounding therapeutic treatment is both thoughtful and impressive. I sought to have this doctor involved in the treatment of Ayn. It is this doctor who we now place our trust in doing their very best to facilitate the return. 

The agreement reached is pretty much simply that. The details are few and the "strings" are not attached. The MCFD and myself have agreed to defer to that expert, as per medications... it is agreed that I will be removing her from them upon her return. The only obligations placed upon me are that 1) I utilize the services which have sought. 2) that I consent to the release of information regarding my progress thereof to the ministry. That's it. So to end much speculation, for all intensive purposes there are no strings attached.

And then Derek answered some questions:

As per timeframe I think that we have to have consultations with them to see what their thoughts are on this subject. I have agreed to "engage and participate" with them, I will do so, and believe there will be a meeting this week to go over what we want to get done prior to her return. The timeframe is open ended technically but we do not expect it will be very long, I am going to speculate that it will be over one month but less than three.

I suppose there is technically a chance that it could be before christmas, ie. that is not precluded. However I think that it is highly unlikely unfortunately. I believe we are going to set up a program with Lyric and once up and running Ayn will come home. The program will be an intensive ABA program which will involve the hiring and training of Behavioural Interventionists, given the time of year that may prove difficult in terms of scheduling.

I whole-heartedly agree that Ayn should be returned immediately, however I have bound myself to the advice of my chosen professional and will honour that. He is wise and will no doubt be very thoughtful in whatever and however he chooses to implement her return. And really the "expert" is not specifically limited to one person as this clinic has a number of professionals whose opinions we will be drawing upon. They not only offer behavioural consultation but also speech and language therapy and psychological services, amongst others. I am very happy and excited to have them working with my kids.

Yes I have discussed the return with Wyatt and Lou already, Wyatt ofcourse is very excited and Lyric though not grasping what exactly that means is proudly wearing his Ayn shirt as he clearly has not forgotten her and misses her dearly, and its really the only shirt he wants to wear, the only one he wants me to wear as well for that matter 

........................

And so the end begins. We will hope for news soon that Derek and his family have been reunited with Ayn. Until then we can rest assured that Derek is in control again of providing a loving , nurturing environment for all his children, where they will continue to thrive. Once Ayn is home we will understand and respect their need for privacy as they rebuild their lives together.

Ayn, Daddy is coming!

COULD THIS HAPPEN TO YOUR FAMILY?

ARE YOU AWARE and TAKING NECESSARY PRECAUTIONS?

490 days ago a little 9 year old girl with autism,in British Columbia, Canada wandered away and was very happy when found and returned home! All was well until ............... 3 days later Child Protective Services, MCFD, asked dad to voluntarily give her up to custody to lighten his load. That did not happen! So they abducted her from school and he has not seen or heard from her since and although he was promised regular reports, the few he got probably ended a year ago. 

So she has been living in a foster house in a locked basement apt with paid staff watching her - costing taxpayers thousands of dollars a month. This is crime against a child, punishing her because she is autistic and wandered away for a few hours. Do you punish your autistic child when they wander?

IS THIS HOW YOU WANT YOUR TAX DOLLARS SPENT TO CARE FOR OUR CHILDREN?

There is no concern about dad's parenting abilities or the care being provided since he still has his 2 sons and one is autistic. If CPS felt dad needed help why wouldn't the government of British Columbia (and right across Canada, North America, globally) provide in home support where this little girl is loved and thrives?

Perhaps some answers will be provided in court finally, pretrial hour this month , trial beginning in Dec with last trial date 69 days later in Feb 2013. (these dates were chosen back in Jan 2012!

BE AWARE!

Many, many children with autism wander.............. watch your child carefully or use a tracking device just in case they wander, then you will quickly find them.

HEAR US SCREAMING “NO MORE!”

On September 19, 2012 Ron Unruh wrote DEREK LOVES HIS DAUGHTER OH SO WELL http://ronunruhgps.blogspot.ca/2012/09/derek-loves-his-daughter-oh-so-well.html?spref=fb and received a challenging response from someone unknown! I always have to wonder the reason for one to hide behind the signature “Anonymous”. Ron brought this comment to Ayn’s parents Amie and Derek who had these responses.

In response to the question of why Ayn wasn’t placed with her mom when taken from her father Amie replies, “As to why Ayn is not with me now... I have been ABLE and WILLING to take Ayn from the beginning. There would have been details to work out (eg. I live in a one bedroom). I assure you, rather than having my only daughter being drugged in foster care, I would have worked out the details."

Derek's response to questions are as follows:

"To begin with I would say to Anonymous I can appreciate your questioning the details of this case and in fact do very much welcome it. Your questions are certainly valid, however it would be far more objective if you waited for a response before casting judgement upon Ron's objectivity.

Now as per your question "Derek says the dosage is twice the amount recommended. However, is Derek a pediatrician or a child psychiatrist?" This is actually untrue I have never said that, what I have done is quoted the prescribing doctor who first saw Ayn after removal. She was placed into acute psychiatric care and I have extensively quoted her discharge papers which were provided to me. MCFD would not attach this hospital report to their affidavit so in order to get it before the courts I had to attach it to mine. Here is the quote directly from the report itself, which was written by the Doctor: "chlorpromazine 75mg PO q4h PRN, 10 dose prescription given (note: this dose can only be given twice per 24h, as technically the maximum dose for her size is not much more than 75mg daily!" The exclamation point is the Doctors not mine.

As a side note I would urge those curious to review several other quotes taken from the hospital report: such as: "We saw no bruises or evidence of physical abuse, and her body status (weight, height, vital signs) showed no evidence of neglect." "She is autistic" "Pediatrics consult by Dr. ***** revealed a normal, healthy young girl with no physical concerns" (I am withholding the doctors names for their privacy) "Ayn was occasionally aggressive as she was expecting to go home."

Now as per Chlorpromazine and its description as a chemical lobotomizer, this is due to two factors firstly it replaced the physical lobotomy's which were being performed at the time and secondly due to its similar effects on the frontal lobe's activity. "The blunting of conscious motivation, and the inability to solve problems under the influence of chlorpromazine (Thorazine) resembles nothing so much as the effects of frontal lobotomy. . . Research has suggested that lobotomies and chemicals like chlorpromazine may cause their effects in the same way, by disrupting the activity of the neurochemical, dopamine. At any rate, a psychiatrist would be hard put to distinguish a lobotomized patient from one treated with chlorpromazine." - Peter Sterling, neuroanatomist, article Psychiatry's Drug Addiction, New Republic magazine (March 3, 1979)" One need only do minimal searching to locate the information on this drug which was marketed as a "chemical lobotomy" http://www.youtube.com/watch?v=_0aNILW6ILk

Now in answer to your third question it can be answered quite simply, Amie was not considered for custody as no relative was, and just as no foster home in the province was, Ayn was deemed unsuitable for foster care. Ayn was removed under the pretext that she was suffering from some undiagnosed 2nd condition, one which was never named, but she was portrayed and treated as an acute mental patient in urgent need of help, by MCFD. This is so troubling because though I rationally disputed this and the acute psychiatric hospital refused to keep her finding no other condition than autism the MCFD continued to pursue a path of psychiatric treatment. Telling me bluntly that they were still going to pursue it but would simply seek a placement within a residential psychiatric facility, it was not until their own autism specialist, a Dr, said that they could not do that as Ayn was simply autistic that they relented, this was not until day 45. Which also begs the question why was she not returned with apologies at that time.
